These Terms of Use ("Terms") govern your use of www.kwiinkulturefoundation.org (the "Site"), operated by the Kwiin Kulture Foundation ("we," "us," or "our"), a 501(c)(3) nonprofit organization. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site is an informational website describing the mission and programs of the Kwiin Kulture Foundation, including the Digital Dignity Initiative, which works to protect and empower creators in the digital age. The Site does not currently accept online donations and does not offer goods or services for sale. If we add donations, programs, or services in the future, additional terms will apply and will be presented at that time.

2. Eligibility

You must be at least 13 years old to use the Site. Children under 13 should use the Site only with a parent or guardian.

3. Intellectual Property

All content on the Site - including text, images, artwork, videos, logos, and the Kwiin Kulture Foundation name and branding - is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, personal, non-commercial license to view the Site. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except as permitted by law (such as fair use).

Copyright complaints (DMCA)

If you believe content on the Site infringes your copyright, please send a notice including (a) identification of the copyrighted work, (b) identification of the allegedly infringing material and its location on the Site, and (c) your contact information and a statement made under penalty of perjury, contact us via our contact us form.

4. Acceptable Use

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms;
Attempt to gain unauthorized access to the Site, its servers, or related systems;
Scrape, harvest, or collect information from the Site by automated means without our permission;
Impersonate us, our founders, or any other person or entity;
Interfere with the proper functioning of the Site.

5. Contact Form

Messages submitted through our contact form are used solely to respond to your inquiry. Submitting the form does not create any partnership, agency, or business relationship with the Foundation, and we are under no obligation to respond to any particular message.

The Site links to third-party websites and social media platforms (including Instagram, TikTok, YouTube, and Facebook). We do not control and are not responsible for the content, products, or practices of third-party sites.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED $100.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

10. Governing Law

These Terms are governed by the laws of the State of Gergia, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time - for example, if we re-enable online donations or add programs or services. We will update the "Last updated" date above, and your continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.

12. General

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms constitute the entire agreement between you and us regarding the Site.
